Terms of Use of Izzie IT Sites and Platforms

• DBizzie: Database performance monitoring and management tool;
• Hub Izzie: Centralized platform for product management and customer support;
• FinOps Tools: Solutions for cloud computing cost optimization.

1. Purpose

These Terms govern the access and use of IZZIE IT's websites, products and platforms, including all content, features and services offered. The software is made available through a contract, without transfer of ownership.

2. Definitions

USER: Any person who accesses the sites, registers on the platforms or uses the interactive features.

CONTRACTOR: Individual or legal entity that contracts IZZIE IT services and is legally and financially responsible for the access made by their users.

3. Access and registration conditions

• The USER must provide truthful, complete and up-to-date information;
• Access is personal, non-transferable and restricted to persons with full legal capacity. Minors may only use the services with authorization from a legal guardian;
• IZZIE IT may refuse or suspend access with signs of fraud, misuse or violation of these Terms.

4. Product use license

IZZIE IT grants a limited, non-exclusive, non-transferable and revocable license to use its software and platforms according to the contracted plans.

The USER is prohibited from:

• Reverse engineering or modifying the systems;
• Sharing access with unauthorized third parties;
• Using the services for illicit purposes or that violate these Terms or applicable legislation.

IZZIE IT may immediately suspend access in case of contractual breach or suspected fraudulent activity.

5. Intellectual property

All content on the sites, trademarks, software, platforms and technical materials are protected by copyright, industrial and intellectual property rights, belonging exclusively to IZZIE IT. No property rights are transferred to the USER.

6. Privacy, cookies and personal data

IZZIE IT may record access logs, including IP, date, time and pages accessed, as well as use cookies and tracking tools, in accordance with applicable legislation and the terms of the Cookie Policy available on the official Izzie IT websites.

Personal data collected is processed in accordance with the General Data Protection Law (Law No. 13.709/2018) and the Brazilian Civil Rights Framework for the Internet (Law No. 12.965/2014), under the terms of the Privacy Policy.

The CONTRACTOR is responsible for the data entered into the systems by its users, including third parties.

7. Support and availability

Technical support will be provided via email and chat, on business days, from 8am to 6pm (Brasília time). The systems will be available 24 hours a day, except for scheduled interruptions or force majeure events.

8. Limitation of liability

IZZIE IT will not be responsible for:

• Usage errors, equipment failures or USER connection issues;
• Loss of profit or data due to indirect failures;
• Interruptions caused by third parties or events beyond its control.

Exceptions are made for cases of intent or gross negligence, in accordance with current legislation.

9. Cancellation, refund and account deletion

The rules regarding cancellation, renewal and refund are set forth in the Refund and Cancellation Policy.

After cancellation, data will remain stored for up to 90 days, according to the Privacy Policy, and will be permanently deleted after this period, unless otherwise provided by law.

10. Changes to the terms

Izzie IT reserves the right to change these Terms at any time. Changes may be communicated and will take effect on the date specified in the publication.

11. Conflict resolution

Before going to court, the parties may seek mediation under Law No. 9.307/1996. If arbitration is not chosen, the contract will establish the jurisdiction to resolve any disputes.

12. Applicable law and jurisdiction

These Terms will be governed by the laws of the Federative Republic of Brazil. The jurisdiction of the District of Gravataí/RS is elected, unless otherwise agreed between the parties.
